We advise our client regarding the viability of filing a Petition to Rescind the Statutory Summary Suspension and conducting a hearing before the judge, which could result in rescission of the suspension.
In the alternative, we will assist our clients in their application for a Monitoring Device Driving Permit or a Restricted Driving Permit. If a person is granted a Monitoring Devise Driving Permit (MDDP) or Restricted Driving Permit (RDP), he/she will be required to have a Breath Alcohol Ignition Interlock Device (BAIID) installed in their vehicle before he/she is permitted to drive. The Secretary of State's office monitors the BAIID throughout the duration of the permit and can revoke the permit if the BAIID detects alcohol or tampering.
First-time DUI offenders are typically charged with a Class A Misdemeanor, carrying penalties up to one year in jail and a fine up to $2,500 plus court costs. The penalties for each subsequent DUI offense are increased, up to a sixth or subsequent offense, charged as Aggravated DUI, which can be charged as a Class X felony, with a sentencing range of 6 to 30 years in prison and a fine up to $25,000 plus court costs.
